Softel vdm, Inc. (“Softel vdm”, “we”, “us” or “our”) is firmly committed to protecting your privacy. This Privacy Policy explains what personal information we collect through this web site, how we use and protect it, who we share it with, and the rights you have over it. It applies to softelvdm.com and the products and services we offer through it.

We sell professional software development components and tools, primarily to businesses and individual developers. Our services are not directed to children.

We do not sell or rent your personal information, and we do not share it for advertising purposes.

Information We Collect

Information you provide to us

  • Registration and account information — when you register, request a demo or trial, create an account, or log in: your name, company, email address, postal address, telephone number, and the username and password for your account.
  • Order information — when you purchase a product or service: your contact and billing information and the details of your order. Payments are processed by PayPal (see below); we do not collect or store your full payment card number.
  • Support and correspondence — information you provide when you contact us for support, ask a question, or otherwise communicate with us, including by email or SMS.
  • Marketing preferences — your choices about whether to receive product news and announcements from us.

Information collected automatically

  • Log data — when you visit the site, our servers automatically record your IP address, the date and time of your request, the pages you view, the page that referred you, and basic information about your browser and device. We use this to operate, secure and troubleshoot the site.
  • Order and download activity — your IP address is recorded during ordering and product-download sessions. We use this for billing, license delivery, and to detect and prevent fraud, payment-card fraud, copyright infringement and license-agreement violations, and to report such activity where appropriate.
  • Cookies — see the next section. We do not use analytics, advertising or third-party tracking cookies.

Cookies

Cookies are small files stored by your browser. We use only cookies that are necessary for the site to work for you:

  • to keep you logged in, so you can access user-specific information such as license keys and product downloads;
  • to keep track of your ordering session, so you can interrupt an order and resume it later;
  • where possible, to remember the contact information you have entered on our forms so you do not have to re-enter it.

We do not use cookies for any other purpose, and we do not use them for advertising or to track you across other web sites. You can browse the publicly accessible parts of the site without cookies, but if your browser blocks cookies you will not be able to log in or access user-specific information online (that information remains available to you by email). You can control or delete cookies through your browser settings. Because we are not part of any cross-site advertising network, browser “Do Not Track” signals do not change how this site behaves — we do not track you in the first place.

How We Use Your Information

We use the personal information we collect to:

  • process your orders, deliver products, license keys and downloads, and provide the services you request;
  • bill you for products and services and process payments through PayPal;
  • create and administer your account and authenticate you when you log in;
  • provide customer and technical support and respond to your enquiries;
  • send you transactional messages — order confirmations, license deliveries, renewal reminders, and important product or security notices — by email or SMS;
  • with your consent or where otherwise permitted, send you product news, updates and announcements; you can opt out at any time, and opt-out instructions are included in each marketing email;
  • operate, maintain, secure and improve the site; detect, investigate and prevent fraud, abuse, and violations of our license agreements or applicable law; and
  • comply with our legal obligations and enforce our agreements.

Legal Bases for Processing (EEA, UK and Switzerland)

If you are in the European Economic Area, the United Kingdom or Switzerland, we process your personal information on the following legal bases:

  • Performance of a contract — to fulfil your orders, deliver and license our products, operate your account, and provide support.
  • Legitimate interests — to secure and improve the site, prevent fraud and protect our intellectual property, and (where it does not override your interests) keep you informed about products similar to those you have obtained from us.
  • Consent — where we ask for it, for example for certain marketing communications; you may withdraw consent at any time.
  • Legal obligation — to comply with applicable laws, tax and accounting requirements, and lawful requests from public authorities.

How We Share Your Information

We do not sell, rent or trade your personal information. We share it only in these limited circumstances:

  • Service providers — with a small number of providers who process information on our behalf, under contract, and only as needed to provide their service: PayPal (payment processing), Twilio (sending and receiving SMS messages), and privateemail.com (email delivery). Our web site and customer data are hosted on our own servers in a secure data center; we do not use a third-party cloud host for them.
  • Legal and safety reasons — when required by law, court order or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, enforce our agreements, investigate fraud, or protect the safety of any person.
  • Business transfers — if Softel vdm is involved in a merger, acquisition, financing or sale of assets, your information may be transferred as part of that transaction; we will require the recipient to honor this Privacy Policy.
  • With your direction — when you ask us to share it, or as required by us to process an order or shipment you have requested.

Each of these providers has its own privacy practices, described on their respective web sites (PayPal, Twilio, Namecheap / privateemail.com).

International Data Transfers

Softel vdm is based in the United States, and the information we collect is processed and stored there. If you access the site or provide information from outside the United States — including from the EEA, the United Kingdom or Switzerland — you understand that your information will be transferred to and processed in the United States, which may not provide the same level of data-protection law as your home country. If you provide your information to us in order to obtain our products or services, this transfer is necessary for us to perform our contract with you and to provide what you have requested.

How Long We Keep Your Information

We keep personal information only as long as we need it for the purposes described in this Policy:

  • account, license and order records are kept for as long as you have an account with us, and afterwards as needed to support your licenses, honor renewals and warranties, resolve disputes, and meet tax, accounting and other legal requirements;
  • payment-card information is not retained — as soon as an order has been processed, any associated card information is permanently removed from our web servers and is no longer accessible online (PayPal retains payment records under its own policy);
  • support correspondence and marketing-preference records are kept for as long as needed to provide support and to honor your choices;
  • server log data is kept for a limited period for security and troubleshooting and is then deleted or aggregated.

When we no longer need personal information, we delete it or irreversibly anonymize it.

Data Security

We maintain administrative, technical and physical safeguards designed to protect personal information against loss, misuse, unauthorized access, disclosure and alteration. Our site is served over encrypted (HTTPS/TLS) connections; customer data is held on our own servers in a secure data center with access limited to personnel who need it; order information is stored encrypted; and payment-card information is removed from our servers once an order is processed. No method of transmission or storage is completely secure, but we work to protect your information and to keep our safeguards up to date.

Your Privacy Rights

Depending on where you live, you may have some or all of the rights described below. We will not discriminate against you for exercising them.

If you are in the EEA, the United Kingdom or Switzerland

You have the right to request access to the personal information we hold about you; to have inaccurate information corrected; to have your information erased; to restrict or object to certain processing; to receive a copy of the information you provided in a portable format; and, where processing is based on consent, to withdraw that consent at any time. You also have the right to lodge a complaint with your local data-protection supervisory authority.

If you are a California resident

Under the California Consumer Privacy Act (as amended), you have the right to know the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collecting it, and the categories of third parties with whom we share it; to request deletion of your personal information; to request correction of inaccurate personal information; and to opt out of the “sale” or “sharing” of personal information. We do not sell or share personal information for cross-context behavioral advertising, and we do not use sensitive personal information for purposes that would require an opt-out. California’s “Shine the Light” law also lets California residents request information about disclosures of personal information to third parties for those parties’ direct-marketing purposes — we make no such disclosures.

How to exercise your rights

To make a request, email us at (email) or write to us at the address below. We may need to verify your identity — and, for an authorized agent, that the agent is acting on your behalf — before acting on a request, and we may retain some information where the law allows or requires it. We will respond within the time required by applicable law.

You can also update or correct your account and contact information yourself at any time using the registration and account forms on the site, and you can opt out of marketing emails using the unsubscribe link in any such email.

This site contains links to web sites operated by others. We are not responsible for the privacy practices or the content of those sites. We encourage you to review the privacy policy of any site you visit.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where the changes are significant, provide a more prominent notice. Your continued use of the site after an update means you accept the revised Policy.
